The solution to all these problems is really p2p caching at the ISP level. I know it can't be done yet but someone should really develop that solution.
If many people on an ISP's network are all getting the same torrent, instead of pulling in ~4GB into your network from your upstream provider for each user you could cache each piece and deliver the pieces from within your own network, thereby reducing your costs significantly. Of course this will only benefit very popular torrents on your network...
CISCO and companies like it should be working on these kinds of solutions instead of ISPs having to fight their customers for the kinds of service they want.
